Overview
Brazil has a federally regulated mining regime, where all mineral resources are property of the Union, as established in Article 176 of the Brazilian Constitution. This means landowners do not own the minerals beneath their land, and mineral rights must be acquired via title from the federal government, regardless of the land’s surface ownership.
The system is administered by the Agência Nacional de Mineração (ANM) — Brazil’s federal mining regulator created by Law No. 13.575/2017, replacing the former DNPM (National Department of Mineral Production).
