Compliance
The Compliance table offers a clear view of upcoming and overdue activities required to comply with relevant Western Australian legislation. Data from the Mines Department is analysed to determine due dates and completeness levels, forming the basis of the table.
Note: Compliance records are generated using data provided by the Mines Department. Currently, Western Australia (WA) is the only jurisdiction that makes this data available for download, so compliance records are not available for non-WA tenements.
Compliance calculations are standard and cannot be customised for individual clients. For custom criteria, tasks, or dates, users should utilise LandTracker actions.
Overdue activities that are not addressed remain in the system for up to 12 months after their due date.
Expenditure compliance
Expenditure (Form 5) reports are due within 59 days of a tenement's anniversary. If the minimum expenditure requirement has not been met, an Exemption must be requested by the same due date. Additionally, a Final Form 5 must be submitted within 59 days of a tenement's death date.
The following expenditure compliance rows are generated:
-
The next Expenditure Report that is due for each tenement within the next 2 years and has not yet been submitted.
- Any Overdue Expenditure Reports.
- An Exemption is flagged as due or overdue if an expenditure report has been submitted but the minimum expenditure has not been met, and one of the following conditions applies:
- No exemption request has been submitted, or
- All submitted exemption requests have been withdrawn or refused.
- If an exemption has been submitted and is in a Recorded or Pending status, it appears in the Compliance table as Pending Approval.
- Final Form 5 is displayed if the tenement has died within the past 12 months and an expenditure report has not been submitted since the death date.
Expiry Compliance
The following Expiry compliance rows are created:
- Renewals—The due date for renewals is 30 days before expiry.
- Previous Renewals—That have not yet been granted. These have a Pending Approval status.
- Next Renewal:
-
A Retention Licence with a Pending previous renewal will not have a Next Renewal record as varying terms for Renewals mean that its next expiry date cannot be calculated.
-
A tenement with a Conversion Dealing will still have a Next Expiry record, but its details will include information from the dealing(s).
-
- Final Expiry—A Prospecting Licence that has been renewed once, therefore cannot be renewed again, has a Final Expiry. The due date for these records is set to the expiry date.
Partial Surrender Compliance
For Exploration Licences of greater than 10 blocks, a compulsory partial surrender of 40% of the area is required by the 4th anniversary. This may include one or more voluntary surrenders.
Note: Partial surrender compliance is not supported for tenements that were applied for on or before 10 February 2006.
-
A partial surrender compliance record exists if the Current Area is greater than 60% of the Grant Area (rounded to the nearest whole block) and the tenement does not have an approved Retention status.
-
The partial surrender is due if the 4th anniversary has not yet been reached.
-
If the required area is not surrendered before the 4th anniversary, the partial surrender is overdue.
-
Details shows the number of blocks that are left to be surrendered, and takes into account any previously surrenders.
Rent compliance
The following Rent compliance rows are created:
-
The next rent that is due for each tenement within the next 2 years and has not yet been paid.
-
Any overdue Rent payments.
-
The due date is 29 days after the anniversary, except for Prospecting Licenses that are about to reach the 8th anniversary.
Technical Report Compliance
Note: It is not possible to determine whether a report has been submitted, so reports cannot be shown as overdue. Once the due date has passed, the row is replaced with a technical report for the next due date.
Technical Reports are required for WA exploration, mining, prospecting, retention and coal mining lease tenements.
If the tenement is a member of a Combined Reporting Group (CRG), the CRG Technical Report is due on the CRG's Report Date.
If the tenement is not a member of a CRG, its Technical Report is due 60 days after its anniversary date.
A final Technical Report is also due 60 days after the Death Date. The following technical report compliance rows are created:
-
The next Technical Report that is due for each tenement.
-
If the tenement is in a CRG, the Name displays the CRG, and Details show the reporting period and members.
-
If not in a CRG, the Name shows the tenement's name, and Details show the reporting period.
Note: When a tenement is imported to LandTracker, individual Technical Report Compliance records are created. If part of a CRG, these update to CRG Technical Reports after the first Update from LandTrack Data Service.
-
-
Any Final Technical Report that was due within the last 60 days.
Compliance Errors
Occasionally, anomalies in Mineral Titles Online data may prevent a tenement's data from being analysed for compliance. If this occurs, an error displays in the Compliance table with additional details to help identify the issue.
For example, if a live tenement is missing a Commence Date, due dates cannot be calculated.
To troubleshoot compliance errors:
-
Review tenement details for any undetected compliance issues, such as due dates for Rent and Expenditure reports.
-
Contact the Department of Mines, Industry Regulation and Safety if data in Mineral Titles Online is incorrect or missing.
-
Contact LandTrack Systems support.
